Introduction: FSSAI Licence/ Registration

The FSSAI license / Registration is a process in which all the food business operators are provided with the certification that their food product quality is good and healthy for consumption. When the approval is given then an FSSAI applicant will get a 14 digit FSSAI License number which certifies you. The FSSAI License/ Registration is made under the Food Safety and Standard Authority of India ( FSSAI). FSSAI is the regulatory body which looks after the food security and provides the certification of adulteration-free food.FSSAI is also known as the food authority of India. The execution of FSSAI Rules and Regulations is undertaken by the Ministry of Health & Family Welfare, Government of India which is headquartered in New Delhi. Types of FSSAI License / Registration 

These three types of food license/ registration in India which are essential to obtain for all the food business according to their eligibility criteria.

1) BASIC FSSAI REGISTRATION 

The small-sized food business operators like manufacturers, transporters, distributer, retailers, etc are eligible to get Basic Registration. The Annual Turnover these food business is less than Rs.12 lakh and this is the criteria.

Who is Eligible to apply :

  • An FBO with an annual turnover of not more than Rs. 12 Lakhs
  • Petty retailer dealing in food products
  • A person who manufactures or sells any food article on his own
  • Food sale is done by the temporary stallholder
  • Any individual who distributes food in any religious or social gathering excluding a caterer
  • Small-scale or cottage industries running in the food business

Procedure to apply :

  • For licensing it is mandatory FBO has an active email ID and a telephonic phone number.

Documents required:

  • Latest Passport-sized photograph of the applicant
  • Identification proof (voter ID card or Aadhaar Card)
  • PAN Card

  • Copy of Property papers (if owned)
  • Copy of Rent Agreement and NOC letter from the Landlord (if rented)

Note: The Basic Registration is common documents for all licenses.

2) STATE FSSAI LICENSE

The medium-sized food business operators like manufacturers, transporters, etc are eligible to get State Registration. The Annual Turnover these food business is between Rs.12 lakh- Rs.20 crore and this is the criteria.

Who is Eligible to apply :

  • Dairy Units processing or chilling 501 to 50,000 LPD
  • Slaughter Units processing 50 animals or 1000 kg/day
  • meat processing units processing up to 500 kg of meat per day
  • meat processing units processing up to 500 kg of meat per day
  • large industries dealing in the food business

Procedure to apply :

  • Check the eligibility criteria as mentioned by the Food Safety and Standards Authority of India.

  • Name and list of equipment and machinery along with the number, installed capacity and horsepower applied.
  • Photo identification and address proof 
  • List of food categories desired to be manufactured.
  • Authority letter- Name & address of the responsible person nominated by the manufacturer.
  • Proof of possession of premises Sale deed / Rental Agreement / Electricity Bil.
  • Partnership Deed or Declaration for Proprietorship or MOA & AOA
  • Certificate of Incorporation 
  • NOC & Copy of License from the manufacturer
  • Form IX
  • FSSAI Declaration Form

3)CENTRAL FSSAI LICENSE

The large-sized food business operators like manufacturers, 100% export oriented units, importers, etc are eligible to get CentralRegistration. The Annual Turnover these food business is more than Rs.20 crore and this is the criteria.

Who is Eligible to apply :

  • 100% of export units
  • Dairy Units processing or chilling more than 50,000 LPD
  • Slaughter Units processing more than 50 animals or 1000 kg/day
  • meat processing units processing more than 500 kg of meat per day
  • Food processing units processing more than 2MT/day.
  • Proprietary Food Business Operators

Procedure to apply :

  • Check the eligibility criteria as specified by the FSSAI.

  • Authority letter 
  • Analysis report Chemical & Bacteriological of water to be used as an ingredient in the food.
  • Proof of possession of premises Sale deed / Rental Agreement / Electricity Bill.
  • Partnership Deed or Declaration for Proprietorship or MOA & AOA 
  • FSMS Plan or Certificate
  • NOC from Municipality or Local Body (optional).
  • Ministry of Commerce Certificate for 100% EOU.
  • NOC/PA documents issued by FSSAI.
  • IE Code document issued by DGFT.
  • FSSAI Form IX
  • Documentary proof of turnover or self-declaration of the number of vehicles as it is compulsory for Transporters.
  • FSSAI Declaration Form

Validity of Food License

FSSAI License or registration is valid for a period ranging from 1-5 years. The Renewal of the food license must be applied for all type of licenses/ registration before 30 days of the expiry of the existing registration. Any FSSAI Renewal Application filed goes above the expiry date is asked for a late fee of Rs.100 for each delayed day.

Fees Structure for FSSAI License

Non- Compliance

 FSSAI appoints a Designated officer to conducts random inspections and tests the food articles or the process. The Food Safety Official (FSO) or the DO is allowed to examine the business premises, safety, and quality of the process or the food item. They have a checklist in which FBO is rated according to their level of compliance that is :

  •  Compliance (C)
  •  Partial compliance (PC)
  •  Non-compliance (NC)
  •  Not applicable/Not observed (NA)

After the inspection, a DO can issue Notice for Improvement. In which FBO is asked to make modifications in a specified duration. If the FBO fails to include these adjustments in time, a Show Cause Notice is provided. This Show Cause Notice provides a date of hearing in the FBO has to justify why it could not make the improvements or changes. If the FBO has logic to believe that the Notice of Improvement is biased or untrue, it can Appeal to the State Commissioner for Food Safety. If the applicant is not satisfied with judgment they can approach the Food Safety Appellate Tribunal or the High Court to file the subsequent appeal.

Penalties for Non-Compliance

The food business operators are compelled to follow the standards prescribed by FSSAI about the operations of food businesses. Any failure to following the guidelines established by FSSSAI can attract FBO to be liable for a penalty.

Cases: Cancellation and Transfer of  FSSAI License

 Cancellation of Food License- The license can be canceled due to various reasons it can be food poisoning that spread diseases. Food Business Operator’s non-compliant premises. Violation of FSSAI rules and regulations. Interrupting an officer of FSSAI during inspections. Ignoring the improvement notice or other legal notice. 

Transfer of the issued FSSAI License-In case, death of the Food License holder the FSSAI License is transferred. The transfer of the issued FSSAI License is to the legal representative or any other family member of the deceased. It is compulsory for the next holder to contact the concerned authority to transfer the license in his name. After the successful verification, the application can either be approved.
